The Declaration of Performance, which confirms the performance of the product in terms of its essential characteristics, will be issued by the manufacturer when the product is placed on the market and is covered by a harmonised standard or complies with a European Technical Assessment (if the manufacturer has followed this procedure), thereby assuming responsibility that the product conforms with the declared performance.
Importers or distributors who place a product on the market under their name must issue the declaration of performance under their brand, assuming the same responsibilities as the manufacturer.
A copy of the Declaration of Performance will be delivered by the manufacturer, or where applicable by the distributor or importer, to the recipient of the product or a batch of the product, either in paper format or electronically. Alternatively, the recipient of the product may be provided with access to a copy of the declaration of performance by informing them that they can consult said document on the website of the manufacturer, distributor or importer.
The Declaration of Performance reference is shown on the label as part of the CE marking requirements of the product.

Manufacturers must keep the Declaration of Performance for ten years after the product is placed on the market (Article 11.2).
